Multiple Pathways to Bathos
This isn't even rearranging deck chairs on the Titanic as much as it's dusting off and fluffing up the cushions as the ship takes on water.
Mayor Rudy's "elite strike force" legal team just racked up a stunning 2-35 record when Giuliani's expedited appeal to dismiss millions of ballots in Pennsylvania was quickly shot down in the Third Circuit Court of Appeals. This comes just two days after Judge Matthew Brann, who was a Federalist Society member, shot down Giuliani's appeal on Saturday to toss 7.2 million votes that were cast as mail-in ballots.
Yes, His Honor tried to convince a federal district judge to just toss out over 7,000,000 votes and disenfranchise every Pennsylvania voter who'd cast them and under the most specious of arguments. Judge Brann's take down of Rudy was epic, to say the least, especially when Republican Uncle Fester's argument seemed to hinge on Trump campaign officials being unable to watch the ballots being removed from the outer envelopes.
In fact, Judge Brann said the argument,
"...strained legal arguments without merit and speculative accusations,
unpled in the operative complaint and unsupported by evidence. In the United States of America, this cannot justify the
disenfranchisement of a single voter, let alone all the voters of its
sixth most populated state. Our people, laws, and institutions demand
more.”
He then dismissed the case "with prejudice", meaning Giuliani's team couldn't even file an amended brief in his court. Undaunted, Giuliani then hurtled his shirt-tucking self at the next windmill, corkscrew sword firmly in hand, and filed an appeal with the Third Circuit. But he might as well have tried Judge Brann again because the Third Circuit shot down his expedited appeal almost immediately.
The Third Circuit wrote in its ruling, "This is an untenable proposal. The partial-appeal procedure proposed by
Appellants is contrary to 'the historic federal policy against piecemeal
appeals'.”
It went on to add that they could have gone on because there were so many flaws and speculative leaps in Giuliani's flawed and porous complaint but time forbade such an unpacking.
This came a few hours after Michigan's Board of Canvassers, reluctantly, after hours of speculating on Mayor Rudy's conspiracy theories, certified the state's results. This was a no doubter as Biden had beaten Tangerine Nightmare by well over 100,000 votes.
Pennsylvania's expected to certify their results tonight, meaning this particular Monday is going to be a very bad day for one Donald John Trump.
